Minutes of the meeting of Danby Group Parish Council on Wednesday 10 June in Castleton Village Hall at 6.30pm.
1)Present: Councillors PA Reeves (Chair), LGrout, JRandles, GBanner, RRudsdale, GThompson, IDodsworth and WH Tindall plus five members of the public.
2)Apologies: Were received from Councillor K.Horner.

Mr Steve Reynolds from Scarborough Borough
Council was present to give a presentation on the recycling facilities provided by Scarborough Borough Council. He reported that the Government had set councils' targets for the percentage of waste to be recycled. The targets were: 40% by 2009/10, 45% by 2012/13.
SBC is within 2% of the target for this year. He then clarified what can and cannot be recycled by the household recycling scheme.
The following items can be recycled: paper, clean card, cans, aerosols, cardboard, plastic bottles, garden waste, glass (at recycling points) and textiles (at recycling points).
The following items cannot be recycled: polystyrene, yogurt pots, plastic food packaging, plastic bags, ice cream tubs, old engine parts, general waste and household batteries.
Councillors questioned why only plastic bottles can be recycled. Mr Reynolds replied that there was a good market for the type of plastic used to make all types of bottles but the market for mixed plastics was very poor and not commercially viable at the moment. Therefore SBC only recycles plastic bottles at the moment.
As regards commercial recycling, from 1 April this year SBC has been able to collect the same recyclable materials from commercial properties, as from households. There is a charge for this, but it is cheaper than the present commercial collection agencies which do not recycle the waste. However there is a need to publicise this as only a very few businesses have made use of the scheme. The collection is presently fortnightly but weekly collections can be arranged through SBC's partner, Yorwaste.
Councillors asked about the problems of flytipping. Mr Reynolds replied that SBC is operating a policy of prosecuting flytippers whenever they have evidence. Residents can report instances of flytipping to SBC by ringing the following number, 01723 232323 (Customer First). Councillor Dodsworth asked where aluminium cans go to when collected? Mr Reynolds replied that at present they go to Teeside. Councillor Rudsdale asked if there were to be any more open days at the recycling plant at Seamer Carr. Mr Reynolds replied that more are to be planned but visits can be arranged for interested groups such as the Parish Council. One of the local residents asked if councils attempt to guide Government policy on the smashing of glass bottles collected for recycling. Mr Reynolds replied that a scheme whereby bottles were reused would be preferable but there were other issues involved over which Councils had no input. Mr Reynolds concluded by stressing that recycling was mainly concerned with the overall energy saved by recycling as compared to the energy used to make new items. Councillor Reeves thanked Mr Reynolds for attending the meeting and Mr Reynolds left the meeting.

Councillor Reeves then welcomed PC Whaler who had arrived to give the police report for the past month.
Local policing issues for May 2009
• 16 May – Great Fryupdale – A red Fiat Punto containing at least 2 males was seen acting suspiciously in the area and when the occupants realised they were being watched they drove off at speed
• 21 May – 2 person involved in a 1 vehicle minor injury road traffic collision in the Danby area.
• 23 May – Group of young males and females from Cleveland area located and spoken to as they left the bridge area at the bottom of Castleton following reports they had some sort of weapon with them. They had been camping and were in drink – no weapon found
• 26 May – In the early hours a suspect vehicle made off from a traffic patrol in Castleton and was followed to the Lingdale area where 1 male and 1 female were arrested. The male was later charged with breaching his bail conditions and kept for court with the female given police bail pending the outcome of further enquiries.
• 26 May – A male was harassed in the Downe Arms in Castleton by another male who was subsequently arrested and charged
• 31 May – Early in the afternoon an inflatable boat was stolen from the Post Office in Lealholm.
Latest items of interest:
In accordance with the local priority of Road Safety 4 officers spent the day on 3 June in 4 villages which included Castleton and Danby with the following results:
• 9 breath tests – all negative
• 2 x FPT for failing to wear seat belts
• 1 x FPT for failing to stop at red light at road works
• 1 x advised re double white line system
• 3 x advised re seat belt usage
• 1 x motorcyclist advised re taking hands off handlebars.
After PCWhaler had discussed his report for May, Mrs N.Warburton, supported by two neighbours, complained about the police response to the incident last weekend in which several young people had been camping on the playing fields at Castleton. The group had caused a great disturbance when Mrs Warburton rang the police to complain at about 1.30pm. Other nearby residents had also contacted the police during the night. The disturbance continued for most of the night and all residents present agreed that it had been a most alarming night. However the police did not visit the scene until early the following morning. Mrs Warburton and the other residents were very unhappy about this lack of response and asked who they should contact to get a response? PC Whaler replied that residents with such a concern should ring the control centre repeatedly not just once. Failing that they should ring 999. Councillor Reeves pointed out that it appears that rural areas suffer when Whitby and Scarborough are busy. PC Whaler had not been on duty that night but had endeavoured to find out what had happened. It appeared that the police had been busy in the town and had not reviewed the incident until at least 3 hours after the call from Mrs Warburton. He suggested that repeated calls to the control centre would have alerted the call centre staff to the gravity of the situation and may have resulted in a more immediate response. Councillor Banner was also concerned about the lack of police cover for rural areas when the towns are busy. PC Whaling replied that the police should be able to divide resources according to need. Councillor Tindall asked PC Whaling to report the matter to his superiors and stress how dissatisfied both the residents, and the Parish Council, were to the inaction of the police in response to this incident. Mrs Warburton asked for reassurances from the police that they would attend such an incident promptly in future, as the camping is a frequent occurrence during the summer months. PC Whaling could not offer a cast iron guarantee that the police would attend promptly. However he was confident that if such an incident was repeatedly reported by residents the police would respond accordingly. Councillor Reeves asked PC Whaling to make a written report about the grave concerns of the Parish Council and local residents as a result of this incident. PC Whaling agreed that he would do so.
Councillor Dodsworth asked PC Whaling about the control room at Northallerton, in particular about their response to reported incidents. PC Whaler thought that the situation had improved. However all agreed that better communication of incidents to officers was needed. Councillor Tindall suggested that all tents in the playing fields/river area should be reported to police. He also suggested that sighns could be erected stating that no camping was allowed. Clerk to write to the Court Leet. PC Whaling also reported a telephone scam in operation at the moment involving a company supposedly collecting unpaid bills for BT. This is used to access the credit card details of customers. Councillor Reeves thanked PC Whaling who then left the meeting together with the residents.

3)Minutes of the last meeting: Were accepted as a true and correct record. Proposed by Councillor Grout and seconded by Councillor Randles.

4)Minutes of the AGM – May 2009: The minutes were agreed in principle. Proposed by Councillor Randles and seconded by Councillor Grout.

5)NYCC – Highways: The letter from Nick West dated 26 May regarding the measures required to mitigate the river Esk erosion immediately upstream of Castleton Bridge.
Resolved – the letter was noted.

6)NYCC – Highways – items reported by Councillors:
• Councillor Banner reported that the road near Castleton Cricket field floods repeatedly and is dangerous to traffic.
• Councillor Grout reported that the gullies on Langourne Bank need clearing out. Councillot Thompson reported that the gullies near Old Man's Park also need clearing out as do the gullies above Castleton Church which are in a particularly poor state.
• Resolved – Clerk to write to NYCC asking that they check all gullies in the area and clean out those requiring attention. They should pay immediate attention to the gullies above Castleton Church. If the Highways department inform the Parish Council they would be able to arrange for cones to be placed in position to prevent residents parking their cars and blocking access to the gullies.

7)NYCC – Castleton School Road safety. Councillors agreed to keep this on the agenda.

8)SBC – Signing of Parish Charter. Councillor Reeves is attending Sneaton Castle on 11th June to officially sing the new Parish Charter.

9)SBC – Flytipping. Councillors reported two instances of flytipping.
• Councillor Randles reported that the rubbish left in the layby on John Breckon Road in Westerdale was still there.
• Councillor Dodsworth reported that rubbish had been tipped on the moor near the road from Castleton to Blakey ridge, near Crag Farm.
• Resolved – Clerk to report to SBC on the telephone number given by Mr Reynolds.

10)SBC – Street Cleaning. Councillors agreed that the road from Castleton Village down to the railway station urgently requires cleaning.
Resolved – Clerk to write to SBC asking that it be cleaned and also to Simon Taylor asking if he could clean the footpath at the same time.

11)NYMNP – Abbeyfields Lights. Councillors agreed that all that could be done on this issue had been done.
Resolved – Councillors agreed to remove it from the agenda.

12)NYMNP – Trod below Ash Grove. The letter from Emma Ashton-Wickett was noted. Leave on agenda for a more detailed reply.

13)NYMNP – footpath past Rosedale Intake. The letter from Emma Ashton-Wickett was noted. Leave on agenda for a more detailed reply.

14)Village Caretaker – Councillor Reeves suggested that the Parish Council should ask Simon if he would like to make a grant application to the LEADER fund. She also asked Councillors if they knew of an storage facilities available for Simon to store his equipment in as he has recently had to vacate his storage facility.
Resolved – Clerk to write.
Councillors also noted that Simon had reported on his monitoring form that he had been asked to sweep Langburn Bank by a resident. However Councillors agreed that this was outside the 30mph sign, and therefore not a village caretaker duty.
Resolved – Clerk to write to Simon suggesting this should be a private job not village caretaker work.

15)Renewable Energy – Next meeting is 11 June 2009. Councillor Banner reported that the tenders had been received back for the turbines at Ruswarp. One tender had been accepted and the project seems to be going ahead. Councillor Dodsworth asked what was happening with the proposed turbine at Danby. Councillor Banner replied that there had been many problems and nothing was happening at the moment.

16)Danby Beacon – view marker. Councillor Rudsdale had inspected the viewmarker with her husband and they believed it was best left alone as it was very specialist work. Councillor Dodsworth agreed.
Resolved – all agreed to leave the view marker in it's present condition and remove from the agenda.

17)Affordable Housing – the letters from Sanctuary Housing and Yorkshire Coast homes were noted.
The opening ceremony is on Friday 12 June. 7 Councillors hoped to attend. Clerk to e-mail Ian Simpson. Councillor Thompson asked why the neighbouring residents such as those along Ash Grove did not appear to have been invited. Councillor Reeves replied that she had already considered this issue and had contacted Ian Simpson. She was awaiting a reply but would try and speak to him again.

18)YLCC/RAY – nothing to report.

19)Westerdale Filter House – as already reported in the Police report and in the Village Caretaker's monitoring form the filter house has been boarded up. Councillor Randles therefore proposed that it be removed from the agenda. All agreed.

20)NYMNP – Planning applications.
The Parish Council considered the following application;
• MYM/2009/0302/FL – application for erection of an extension to rear conservatory at Lingberry Bungalow, 2A, Dale End, Danby.
• Response – Councillor Dodsworth proposed no objections and Councillor Thompson proposed that the Parish Council fully support this application. Unanimous agreement.
21)NYMNP – Planning decisions;
• NYM/2009/0169/FL – application for construction of a garden room to north elevation at Beckside Farm, Fryup.
• Response – GRANTED.

22)NYCC – Review of passenger transport services and home to school transport.
Councillor Tindall reported that he had applied to be on the home to school transport committee at NYCC. They are attempting to provide a bus running from Scarborough to Whitby and through to Middlesborough for further education. Councillors agreed with the following response to this review proposed by Councillor Reeves. ' Danby Parish Council fully support the need to maintain and even extend the existing few services in our Parish, especially the bus service to Northallerton. The Council suggests that the services available require more advertising to residents. The timetables are very difficult to obtain. The Parish Council would like to request some posters advertising the buses and some copies of the timetables to distribute.'
Resolved – Clerk to write to NYCC giving the response proposed by Councillor Reeves.

23)SBC- Safety Council meeting – noted.

24)SBC – Schedule of meetings – noted.

25)Castleton School SEF – Councillor Grout agreed to attend on behalf of the Parish Council. Clerk to let Mrs Douglas know.

26)CE Electric UK – priority treatment during power cut leaflets. Councillors agreed to order 50 leaflets to distribute. Clerk to accompany the form with a letter stating that all the bungalows in Castle Close and Robin Hood's Close should be placed on the priority treatment list without individual requests as all are sheltered housing for senior citizens.

27)Grass Verges – cutting of grass verges contract. Councillors agreed that the clerk should write to the following contractors requesting that they tender for the contract;
• Mr R Norris
• Mr & Mrs Houlston
• JTW Contracts from Cloughton.
The letter should request that the verges be completed by the end of July. The Clerk pointed out that there would be no time after discussing the contracts at the July meeting for the contractor to carry out the work before the end of July.
Resolved – Clerk to ring Councillors when tenders received for their decisions on who should be awarded the contract.

28)Financial Risk Assessment – Insurance Premium. Councillor Banner reported that he had inspected the Insurance renewal document from Allianz Insurance and found it to be satisfactory. All agreed that the insurance should be renewed and the premium paid.

29)Advertising the audit of accounts years 2007/08 and 2008/09 – All agreed that the notice advertising the inspection period should be placed on the notice board in Castleton Village Hall.
Resolved – Clerk to draft advert using the template provided and place on the notice board.

31)Items reported by Councillors:
• Councillor Reeves requested the Clerk to look at the insurance documents and see what was paid to insure the playing area. She believes that there may be some money left from the allocation in the model agreement in excess to the insurance. She asked Councillor Thompson if he would accept any excess. Councillor Thompson was ready to accept if the money was available.
• Councillor Rudsdale asked Councillors how many tickets they required for the NYMNP Vol Fest event.
• Councillor Randles reported that the illuminated slow down sign at the top of Castleton is not working properly – Clerk to report.
• Councillor Reeves has sent a congratulatory card to the Abbeyfields committee on behalf of the Parish Council. They are holding an opening ceremony soon.
• Councillor Reeves proffered her apologies for the July meeting, she is on holiday.

32)Borough and County Council reports:
Councillor Tindall reported that Whitby Town Council may try to force a poll in this parish as to if we want to stay with SBC. A poll in Sleights has already been forced. Councillor Reeves proposed that if the Town Councillors in question ring the Clerk requesting a visit to Danby Parish Council the Clerk should decline as we do not want a Poll. All agreed.
