Minutes of the meeting of Danby Group Parish Council held on Wednesday 9 September in Castleton Village Hall.
1)Present: Councillor PA Reeves (Chair) and Councillors L Grout, J Randles, G Banner, WH Tindall, R Rudsdale and G Thompson.
2)Apologies were received from; Councillors K Horner and I Dodsworth.
Police officers Sergeant Ian Donald and PCSO David
Mainprize from Whitby Rural Safer Neighbourhoods Policing Team were present to report on incidents of note in Danby Ward since the last meeting in July. These included a serious road traffic accident between Castleton and Dibble Bridge, damage to the otter sculptures at Danby Lodge, damage caused to a car in Danby Head, and a report of an air rifle being discharged from a taxi between Westerdale and Kildale. Inquiries are ongoing on all incidents. They also reported that the Whitby Rural Watch scheme is now up and running and is being chaired by Cosima Towneley from Mulgrave Estates. There are currently 30 registered members living in Danby Ward. Sergeant Donald also reported that PC Nigel Whaling is currently off work sick and will be for the foreseeable future. His temporary replacement is PC Darren Mortimer. Sergeant Donald reported that the police are still working with rangers from the National Park to try and combat problem behaviour at areas such as Hob Hole. Sergeant Donald then agreed to look into the issue of the cold war bunker that PC Whaling had promised to investigate. After offering our best wishes for a return to health for PC Whaling, Councillor Reeves thanked both officers for attending and they left the meeting.
3)Minutes of the last meeting were agreed as a true and correct record. Proposed by Councillor Randles and seconded by Councillor Tindall.
4)Matters arising:
4.1)NYCC – Highways:
• Discussing the letter from David Creek about gully cleansing Councillor Thompson agreed to meet Councillor Reeves to mark the position of the blocked gullies on the map provided. This will then be forwarded to Councillor Tindall to discuss with Nick West.
• Councillor Banner reported that the road from the Cleveland Inn to Long Green Farm is in a terrible state. Clerk to report.
• Councillor Rudsdale reported that there is large pothole in front of the houses overlooking Canting Hill. Clerk to report.
4.2)NYCC – Castleton School Road Safety. The wig wags have been successfully installed, however it was reported that the wig wag at the top of the village is not working. Clerk to report.
4.3)SBC.
• Street Cleaning. The bank from Castleton to the Station has been cleaned as requested. However the pavements from the British Legion down the bank needs the weeds spraying. Clerk to ask Simon.
• Councillor Thompson requested that two waste bins be installed in Ainthorpe as there are none at present. Councillors agreed to request a bin near the end of Strait Lane with a second near Congrave Farm. Clerk to request.
• Fly tipping – the fly tipping on John Breckon road has been removed.
4.3)NYMNP:
• Trod below Ash Grove. The clerk had been sent a form to apply to the Village Improvement Scheme for the reinstatement of the trod. However three quotes are required and permission must be granted by the landowners, which in this case the Rights of Way Officer suggested will by highways. Councillors suggested quotes be obtained from Simon Taylor, Mike Wetherill and Nigel Henderson. However Councillor Rudsdale did not think that it was an appropriate use of Village Improvement Scheme money. Councillor Tindall stated that he believed that contrary to the view given in the letter by the Rights of Way Officer, the trod is the responsibility of the National Park. He understood that they actually employ a Trod Officer to deal with such issues. The issue of the flags at the bottom of the trod was raised with Councillors agreeing that they were very dangerous. Councillors agreed that Councillor Thompson should take the flags down as soon as possible and that the Clerk should write to the NYMNP informing them that the flags had been taken down.
Resolved: Clerk to ask the three contractors for quotes to reinstate the trod from Ashleigh to the end. Clerk also to write to NYMNP informing them about the flags and contesting the view that the National Park was not responsible for the maintenance of the trod.
• Footpath past Rosedale Intake – Councillor Horner is absent therefore we have no report on this issue.
• Joint Parish Forum – Councillor Banner reported that the Forum had been very interesting and had included tea and a tour of Sneaton Castle. He stated that the National Park appeared to understand our point about the problems with the Moors buses locally. Councillor Reeves also reported that the question of block insurance for Parish Councils had been raised at the meeting. The National Park had forwarded some information to the Clerk which could be investigated then reported on at the next meeting. Agreed to put this issue on the agenda for the next meeting.
4.4)Village Caretaker.
• Monitoring Forms – Councillors discussed the repairs needed to the toilets. Councillor Grout stated the Simon was still waiting for the floor to be sealed in Castleton toilets. Clerk to ask Simon to ring Councillor Tindall with a list of the repairs required so that he could put it to SBC.
• Councillor Reeves reported that she is giving a presentation about the village caretaker at Hutton-le-Hole in conjunction with NYMNP. This is to advise Parish Councils on the possibility of using LEADER money to help fund caretakers. Councillors Randles and Banner agreed to attend the meeting. Councillor Reeves is to ring Simon and ask if he could be present. Councillor Reeves understands that LEADER money cannot be used for existing schemes but that it may be possible to apply if we wished to extend the remit of our village caretaker. Councillor Tindall suggested that it may be beneficial to extend our caretakers remit in winter. Further information should be forthcoming at the meeting.
4.5)Renewable Energy – the AGM and ordinary meeting is to be held on Thursday 10 September.
4.6)Affordable housing – letter refusing our requests for a stone sign and the moving of the lamp post in the car park was noted.
4.7)YLCA/RAY – the nomination papers for representatives to the NYCC Coast and Moors Area Committee had been received. Councillor Grout nominated Councillor Reeves as a representative. This was seconded by Councillor Tindall. Councillor Reeves accepted the nomination. Clerk to send papers.
4.8)Orange Mast – again we have received no reply to our letter dated 20 July. Councillor Reeves suggested a very strong letter requesting an immediate response with a copy sent to the M.P. Robert Goodwill. Clerk to send letter.
4.9)No Camping sign at the six-arch bridge – Clerk to write to Court Leet requesting such a sign.
4.10)Cutting of grass verges outside 30mph signs – Councillor Tindall requested that the Parish Council consider it's position as regards cutting the verges and vegetation outside the 30mph signs. He had received several requests during the summer months from residents on the High Butterwitts road as had the Clerk. Councillors agreed to ask Nick West to attend a Parish Council meeting to discuss the issue. Clerk to write to Nick West.
4.11)Memorial Bench – no further correspondence had been received from the applicant.
5)NYMNP
5.1) Vehicle Activated Sheep Warning Signs – The NYMNP intend these to be up between April and October, however they do not yet appear to be erected. Councillor Tindall will investigate.
5.2)NYMNP – Newsletter. Noted.
5.3)NYMNP Planning Parish Training Event – to be held on 13 October at Helmsley. Councillors Grout, Banner and Rudsdale agreed to attend. The Clerk also expressed interest in attending. Clerk to book places. Councillor Reeves sends her apologies as she will not be able to attend.
5.4)NYMNP – list of members for our records – noted.
5.5)NYMNP – Planning applications:
The following applications were discussed;
• NYM/2009/0559/FL – Application for construction of 2 fenced sand/beach volleyball courts at Danby Sports Ground, Ainthorpe Lane, Danby.
• Response – The Councillors would like to request a deferment of this application. Although they support the idea of the volleyball courts they have concerns about the positioning of the courts in the application. They are making arrangements to discuss this with the Sports committee and so would like to ask that the application be deferred.
• NYM/2009/0554/FL – Application for erection of extension to existing livestock building at Castle Houses, Danby.
• Response – Unanimous. Fully support.
• NYM/2009/0481/FL – Application for alterations and extensions to dwelling at Orchard House, 1, Langburn Lane, Castleton.
• Response – Unanimous. No objections.
• NYM/2009/0576/FL – Application for change of use of agricultural land to domestic garden and erection of a timber garden shed at Mount Pleasant Cottage, 51, High Street, Castleton.
• Response – Unanimous. No objections.
• NYM/2009/0534/FL – Application for erection of a porch extension at Amber Botton Village.
• Response – No comment.
5.6)NYMNP – Planning decisions:
The following planning decisions were received;
• NYM/2009/0315/FL – Application for construction of 3 no. forestry drying sheds at land adjacent Honey Bee Nest, Botton Village, Danby.
• Response – GRANTED.
• NYM/2009/0436/FL – Application for alterations to conservatory roof at Rock House, Botton Village.
• Response – GRANTED.
• NYM/2009/0356/LB – Application for listed building consent for non-illuminated fascia sign at 1, Briar Hill, Danby.
• Response – GRANTED.
• NYm/2009/0302/FL – Application for erection of an extension to rear conservatory at Lingberry Bungalow, 2A Dale End, Danby.
• Response – GRANTED.
6.0)NYCC:
6.1) NYCC – Planning Inspectorate. The planning inspectorate about the application to upgrade the Commondale to Guisborough footpath to a bridleway was noted.
6.2) NYCC Grants available for playsites – Councillor Reeves has noted that NYCC has grants available to develop play areas. She wondered if anyone would be interested in establishing a play area at Danby.
7)SBC – Mapping of areas affected by flooding in the Borough of Scarborough. This request was accompanied by a map but it was of such poor quality with no distinguishing features that Councillors felt unable to mark the areas prone to flooding on the map as requested. Instead they proposed a letter listing all the areas as follows;
• Duck's Bridge area.
• Road from Duck's Bridge to the Moors Centre Car Park.
• Bottom of Howe Bank, Danby.
• Ashfield Road in Castleton.
• Junction of Station Road with Mill Road, in Castleton.
• Shackleton Bridge near Fryup.

7.1) SBC – Planning Services. Councillors would like to thank SBC for sending this list of the Planning services but would like to point out that it is not applicable in our area. Clerk to write.
7.2) SBC – Whitby Business Park Area Action Plan. Councillor Reeves had noted that this plan had little relevance to our area due to a 'lack of integrated transport for rural communities to access this park for employment and customer related activity'. Clerk to write.
7.3) SBC – Business rates deferment – Councillors agreed that this was not applicable to our Parish properties.
7.4)SBC Area Committee Meeting – 7pm on 13 October.
7.5) SBC Register of Members Interests. The Clerk had sent a copy of the form to each Councillor to fill in and return to her at this meeting. Councillors discussed what information was required and several handed their forms to the Clerk for posting to SBC.
7.6) SBC – Planning Council Training Event – Councillor Reeves will attend. Clerk to book place.
7.7) SBC – Safety Council. Next meeting on 23 September.
7.8) SBC – Comprehensive Area Assessment – Consultation. This consultation was noted.
8) Botton Village Invitation. Councillors have been invited to Botton Village for a meeting with David Adams and the LMC. This will be held on 29 October at 6pm. Seven Councillors will be able to attend. Clerk to write.
9) Community Use of the Bradbury Centre as opposed to the Village Halls. Councillor Thompson has spoken to several people who are concerned about the possible removal of trade from the village halls to the Bradbury Centre. Councillor Grout reported that she had attended the Castleton Village Hall meeting and the Secretary reported that bookings were up 30%. She commented that as the Bradbury Centre is actually hiring the hall on many occasions for its events then it is actually benefiting the halls. Many of their events, such as the Gym cannot be carried out in the village halls. Councillors Grout and Reeves were reluctant to involve the Parish Council in this issue with Councillor Grout declaring that it was possible to say that she has an interest in the Bradbury Centre. Councillors Tindall and Banner proposed that the Clerk write to the Chairs of Danby and Castleton Village Hall committees to say that the Parish Council had been approached over some concerns that the bookings at the village halls. Could they reassure us that the bookings have not been adversely affected by the Bradbury Centre activities. Clerk to write.
10) External Audit for the year 2008-2009. The auditors report was noted and the return will be displayed on the notice board in Castleton Village Hall.
11)Correspondence: The following correspondence was received;
• Whitby DAG
• Letter of thanks from Castleton School for the grant awarded by the Parish Council for their new ICT suite.
• Good Neighbours Community Car Transport letter, poster and leaflets. The letter appealed for more volunteer drivers.
• A letter was received from Jan Stamp from the 'Patient Participation Group' attached to Danby Surgery appealing for a grant towards the cost of producing their leaflets. Councillors felt that the information contained was already publicised elsewhere and did not feel that the cost of production would be very great at all. Therefore they agreed not to offer a grant to the group.
• NYMNP – July newsletter for residents
• Playproducts from Streetscape leaflet.
• Country Air – distributed.
• The Playing field – distributed.
• CPRE newsletter – distributed.
• Local Councils – Leaflet about the latest products for Local Councils.

12)Items reported by Councillors;
• Councillor Randles reported on the widespread dissatisfaction of local residents with the stock carried by the newly refurbished Co-op. A variety of residents have been complaining that the Co-op no longer stocks the items they need to buy. Councillors fear that residents will have to travel further afield to do their shopping. They also have concerns about how this will affect the large number of pensioners who rely upon the Co-op. Clerk to write to the Co-op head office.
• Councillor Banner requested a new battery in the clock in Castleton Village Hall.
• Councillor Horner had asked that Councillor Reeves report that rats had been sighted at Danby Lodge near their bird feeders. Councillor Rudsdale agreed that rats had been seen but that they were being dealt with. However she also agreed to report the concerns of the Parish Council.
• Councillor Tindall reported that he has asked the NYMNP if it would be possible to install another swing or some other equipment at the Moors Centre play area as it is very popular.
13)Borough and County Council reports;
Councillor Tindall reported that NYCC was concerned about the disappearance of bees over the County. This could possibly be linked to mobile phone signals. He also reported that the County Council was advising school children about the link between taking drugs and drinking heavily and Alzheimer's disease. He also reported the discrepancy between the amount required to repair and maintain all the roads (£5,000,000) and the money available to the Council (1,000,000). However the contract to repair the roads ends next spring and the old contractor should be replaced as they have not proven very satisfactory.
